Apple Vs Samsung: The Results

Giant Battle Concludes

At Tec Team we try to remain unbiased when it comes to large capable brands such as Apple and Samsung and we understand why one might choose either, whether its brand loyalty, budget or personal preference, especially if your buying a new computer or phone. However I for one have had an iPhone since August 2007 (yes I imported it from the US and hacked it to unlock it) as a keen iPhone user I have been following the have been in a fierce legal battle between these giants over the last few weeks. Each company received 25 hours of court-time to convince the jury in their favour, and an additional 2 hours for closing arguments, until it will the outcome of the trial will be decided by the Jury.

Some have been calling this the patent trial of the century and they could not be more right. The outcome of this trial will push the boundaries of how valuable patents really are. As if Apple wins Samsung will be forced to change a lot of their devices and pay a large $2.5 billion fine. On the flip side, if Samsung wins Apple will also have to pay a large fine and will essentially lose their ‘thermonuclear’ was against Android.

According to numerous sources, like The Verge, the jury has reached a verdict on the outcome of the Apple vs Samsung trial. Apparently this verdict was reached at 2:35 PM and currently Judge Koh is going over the Verdict forms.

Samsung has been found guilty

Infringing on numerous Apple patents on devices like the Captiavte, Continuum, Droid Charge, Exhibit, Prevail, Galaxy S 4G, S II AT&T, SII T Mobile, Galaxy Tab, Gem, Indulge, Infuse 4G, Mesmerize, Nexus S 4G, Tranform and Vibrant.

Samsung has been deemed wilful in its infringement

on most of Apple’s patents (meaning they will receive large damages), and it has been stated that they should have known better.

All of Apple’s patents have been proved VALID

I always felt the Samsung Galaxy was too similar, and of course did the other computer company founder called Steve (Steve Jobs). Like us know what you think on our Facebook Page.

Samsung must pay 1 billion, 51 million 855 thousand dollars in damages

Apple does not infringe on any of Samsung’s utility patents

Total Victory for Apple

Apple does not have to pay Samsung anything for damages

Although Apple has not won everything, it is enough to make this day important, and will mean Samsung has some serious consequences.

Apple’s stocks have jumped to $670 highest ever

What Apple’s CEO Tim Cook Has Said.

Apple CEO Tim Cook addressed corporate Apple employees tonight after the massive win from their patent litigation against Samsung. The email, republished by 9to5Mac, is quoted here:
Today was an important day for Apple and for innovators everywhere.

Many of you have been closely following the trial against Samsung in San Jose for the past few weeks. We chose legal action very reluctantly and only after repeatedly asking Samsung to stop copying our work. For us this lawsuit has always been about something much more important than patents or money. It’s about values. We value originality and innovation and pour our lives into making the best products on earth. And we do this to delight our customers, not for competitors to flagrantly copy.

We owe a debt of gratitude to the jury who invested their time in listening to our story. We were thrilled to finally have the opportunity to tell it. The mountain of evidence presented during the trial showed that Samsung’s copying went far deeper than we knew.

The jury has now spoken. We applaud them for finding Samsung’s behavior willful and for sending a loud and clear message that stealing isn’t right.

I am very proud of the work that each of you do.

Today, values have won and I hope the whole world listens.

A jury found that Samsung had willfully infringed on both Apple’s patents and trade dress for the iPhone and issued a verdict of over $1 billion in damages to be paid to Apple.

What Samsung Have Said

Today’s verdict should not be viewed as a win for Apple, but as a loss for the American consumer. It will lead to fewer choices, less innovation, and potentially higher prices. It is unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners, or technology that is being improved every day by Samsung and other companies. Consumers have the right to choices, and they know what they are buying when they purchase Samsung products. This is not the final word in this case or in battles being waged in courts and tribunals around the world, some of which have already rejected many of Apple’s claims. Samsung will continue to innovate and offer choices for the consumer.

Apple’s spokesperson Katie Cotton Said

We are grateful to the jury for their service and for investing the time to listen to our story and we were thrilled to be able to finally tell it. The mountain of evidence presented during the trail showed that Samsung’s copying went far deeper than even we knew. The lawsuits between Apple and Samsung were about much more than patents or money. They were about values. At Apple, we value originality and innovation and pour our lives into making the best products on earth. We make these products to delight our customers, not for our competitors to flagrantly copy. We applaud the court for finding Samsung’s behavior willful and for sending a loud and clear message that stealing isn’t right.

The extent of the patent violation is summed up really well here
